Terms of Service

Overview

This website is operated by Yoshimin, a business based in Japan. Throughout the site, the terms "we", "us", and "our" refer to Yoshimin.

By accessing our website, creating an account, or placing an order, you agree to these Terms of Service and the policies referenced herein, subject to any mandatory rights you have under applicable law.

Please read these Terms carefully before using our website or purchasing from us.

Nothing in these Terms limits or excludes any mandatory consumer rights available to you under the laws applicable in your country or region.

1. Online Store

You must have the legal capacity required in your country or region to enter into a purchase contract.

You may not use our website, products, or services for any unlawful or unauthorized purpose.

You must not attempt to interfere with the security or operation of the website, transmit malicious code, misuse customer accounts, or use the website in violation of applicable laws.

2. Products and Product Information

Yoshimin specializes primarily in anime figures, model kits, character goods, and collectibles sourced in Japan.

We make reasonable efforts to ensure that product descriptions, photographs, specifications, prices, and availability are accurate.

Colors and appearance may vary slightly depending on your display, lighting, manufacturing variations, or other factors. Where an individual product page contains specific information or conditions, that information applies to the product, subject to applicable consumer law.

Product availability is subject to change, and items may sell out without prior notice.

3. Prices and Currency

Product prices are displayed in the currency selected for your country or region where supported.

Currency conversions may be performed automatically and may change due to exchange rate fluctuations.

The final product price, any shipping charge, taxes collected at checkout, and order total will be displayed before you complete your purchase. Import-related charges not collected at checkout may be payable separately as described in Section 8 and our Shipping Policy.

4. Orders

Submitting an order does not prevent us from cancelling or correcting an order where reasonably necessary, including in cases of:

  • Pricing or listing errors
  • Inventory errors
  • Payment problems
  • Suspected fraud or unauthorized transactions
  • Shipping restrictions
  • Legal or regulatory restrictions
  • Other circumstances that make fulfillment impossible

If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method, including any amounts required by applicable law.

We may contact you when additional information is required to process or ship your order.

Customer-initiated cancellation requests: You may request cancellation of an item that has not yet been fulfilled (normally before shipment) through your customer account or by emailing info@yoshimin.jp. Submitting a voluntary cancellation request does not automatically cancel the item or order; we review and process such requests. If fulfillment has already taken place, please contact us, as a return may be available after delivery.

These voluntary cancellation procedures do not restrict any statutory right to cancel or withdraw from a purchase, including rights exercisable before delivery. A valid statutory withdrawal does not require our discretionary approval, and applicable legal refund deadlines take priority.

5. Payment

Available payment methods are displayed at checkout and may vary depending on your country, region, currency, or payment provider.

Payment is processed according to the conditions shown at checkout and the terms of the applicable payment provider.

You are responsible for providing accurate and current billing and payment information.

6. Shipping and Delivery

Orders are shipped from Japan.

Orders are normally prepared and shipped within approximately 5 business days after payment confirmation, unless otherwise stated on the relevant product page. Business days exclude Saturdays, Sundays, and Japanese national holidays. Processing may take longer during particularly busy periods or when additional inspection is required.

Estimated transit times after shipment are generally:

  • Standard Shipping: approximately 10–20 business days
  • Expedited Shipping: approximately 5–10 business days

Standard Shipping is free for all orders where this service is available, regardless of order value. Expedited Shipping is a paid option where available, at the rate displayed at checkout.

Available delivery methods, shipping charges (if any), and estimated delivery periods are described in our Shipping Policy and displayed at checkout where applicable.

Delivery estimates are not guaranteed delivery dates. Customs clearance, carrier delays, weather, public holidays, local delivery conditions, and other circumstances outside our reasonable control may affect delivery times. Nothing in this section limits any mandatory delivery deadlines or remedies under applicable consumer law.

Please provide a complete and accurate shipping address and respond promptly to reasonable requests from customs authorities and carriers. If you become aware of a delivery problem, contact us as soon as possible.

7. Pre-Orders

Some products may be offered before their official release.

Release dates and estimated shipping dates for pre-order products are based on information available from manufacturers, distributors, or suppliers and may change.

If a manufacturer delays the release of a product, shipment may also be delayed.

Any specific pre-order conditions stated on the relevant product page form part of these Terms, subject to applicable law. Nothing in this section limits cancellation or other rights required by applicable consumer law.

8. Customs Duties, Import Taxes, and Delivery Refusal

Orders are shipped internationally from Japan. Depending on the destination, VAT, GST, customs duties, import taxes, customs clearance fees, or other import-related charges may apply.

Where taxes or duties are collected through our store at checkout, those amounts will be shown before you place your order. Where charges are not collected at checkout, customs authorities, postal operators, or delivery carriers may request payment separately in the destination country. Customers are responsible for complying with applicable import requirements and for paying charges lawfully payable by the recipient that were not collected at checkout.

If you are asked to pay a tax or duty that was already collected by Yoshimin at checkout, or if you believe an import charge has been assessed incorrectly, please contact us promptly so that we can investigate. You should not be required by these Terms to pay the same charge twice.

Unpaid customs charges, refused delivery, and unclaimed parcels. If a shipment is refused, left unclaimed, or returned because the recipient does not pay lawfully payable import charges, does not provide information reasonably required for customs clearance, or provides an incorrect or incomplete address, please contact us so that we can review the circumstances and determine the appropriate resolution.

Such a return is not automatically treated as an approved return under our voluntary 60-day return policy. When the delivery failure is attributable to the recipient, and only to the extent permitted by applicable law, we may deduct from a discretionary refund the reasonable, documented costs actually incurred as a direct result, such as original outbound postage paid by Yoshimin (even if Standard Shipping was advertised as free), return postage, and carrier-imposed return or handling charges. We will explain any proposed deduction and its basis. We do not impose a separate penalty or restocking fee for delivery refusal.

No such deduction will override a valid statutory right of withdrawal, cancellation, refund, or remedy, including where the goods are returned without being delivered. We will not attribute delivery failures or costs to the recipient where they arise from an error by Yoshimin, a charge that should have been prepaid under the checkout terms, or circumstances for which we are legally responsible. Any required statutory refund will be handled under the applicable legal rules, regardless of the status of the shipment.

Where an undelivered shipment is returned to us and a discretionary refund is appropriate, we generally assess the refund after the return and the actual charges are confirmed, subject to any earlier refund deadline required by law. If the shipment is lost, delayed, or cannot be returned, we will investigate and provide any remedy required by applicable consumer law.

If reshipment is requested after a delivery failure attributable to the recipient, additional shipping costs may apply, where permitted by law.

9. Returns, Statutory Withdrawal, and Refunds

Voluntary 60-Day Return Policy

Eligible returns may be requested within 60 days after delivery of the last item in the order, subject to the conditions in our Refund Policy. This voluntary policy is in addition to, and does not replace, your mandatory consumer rights. If the final day of this voluntary return period falls on a weekend or an applicable public holiday, the deadline is extended to the next business day.

For accepted returns under this policy:

  • Return shipping is provided at no cost to the customer, using the return arrangements approved by Yoshimin.
  • There is no restocking fee.
  • Returns are handled by mail.
  • We do not offer direct exchanges.

To request an eligible voluntary return, submit a return request through your customer account or email info@yoshimin.jp within the 60-day return window. Please follow our return instructions before shipping an item back under the voluntary policy so that free return shipping can be arranged. These procedures do not restrict any statutory right of withdrawal or require prior approval to exercise it.

Unclaimed or refused deliveries described in Section 8 are handled separately from approved voluntary returns. They do not automatically qualify for free return shipping under the voluntary policy.

Statutory Right of Withdrawal for EU Consumers

If you are a consumer in the European Union, you generally have the right to withdraw from an eligible distance purchase without giving a reason within 14 days after you, or a person you designate other than the carrier, receive the goods. Where goods from the same order are delivered separately, the period generally starts when the last item is received. Statutory exceptions and any more protective national rules remain applicable.

To exercise this right, notify us of your decision to withdraw by an unequivocal statement sent to info@yoshimin.jp or by using any electronic withdrawal function made available on our website. You do not need our prior approval to exercise a valid statutory right. You may also notify us before delivery where permitted by law.

If you have received the goods, you must return them without undue delay and generally within 14 days after notifying us of withdrawal, unless we arrange collection or the applicable law provides otherwise. Contact us for free return shipping arrangements under our return policy. Your statutory rights are not conditional on obtaining prior authorization from us.

We will reimburse all sums required by applicable EU consumer law without undue delay and, in principle, within 14 days after we are informed of your decision to withdraw. Unless we have offered to collect the goods, we may withhold reimbursement until we have received the returned goods or you have supplied evidence of having sent them back, whichever occurs first, as permitted by law.

The statutory reimbursement includes the cost of the least expensive standard delivery option originally offered where applicable. Our Standard Shipping is free, so no separate standard-delivery charge is payable for reimbursement. If you expressly selected a more expensive delivery method such as Expedited Shipping, any supplementary delivery charge above the least expensive standard option may be excluded from reimbursement where permitted by law.

Refunds under statutory withdrawal are made using the original payment method unless you expressly agree otherwise, without imposing a refund fee. A reduction for diminished value of goods, if any, will be applied only where allowed by applicable law. Opening collectible packaging does not, by itself, eliminate a statutory withdrawal right where that right applies.

Consumers in the United Kingdom and other jurisdictions retain any equivalent or additional statutory cancellation, return, and refund rights and deadlines under applicable law.

Refunds Under Our Voluntary Return Policy

For a voluntary return that is accepted, we will inspect the returned item and promptly inform you of the refund decision. An approved refund will normally be issued to the original payment method within 10 business days after we receive and inspect the item and approve the return, subject to any shorter period or different process required by applicable law.

For a voluntary return, any original paid Expedited Shipping charge is not necessarily refundable unless required by law or the return results from our error. This does not affect statutory rights, including the reimbursement of standard delivery charges where legally required.

Taxes collected by Yoshimin at checkout will be refunded where required by law and as applicable to the refunded transaction. Taxes, duties, or charges paid directly to customs authorities, postal operators, or delivery carriers may need to be reclaimed from those parties and may not always be refundable by Yoshimin directly.

Your bank, card issuer, or payment provider may require additional time to display a refund after we issue it.

For the full return conditions and instructions, please review our Refund Policy.

10. Damaged, Defective, or Incorrect Items

Please inspect your order after delivery.

If an item arrives damaged or defective, if you receive an incorrect item, or if the item materially differs from its description, please contact us as soon as reasonably possible.

We may request photographs of the item, packaging, shipping carton, or shipping label to help us investigate the issue.

We will provide an appropriate remedy in accordance with our Refund Policy and applicable consumer law, including any mandatory legal guarantee rights. Nothing in our voluntary return eligibility rules reduces these rights.

11. Customer Accounts

You are responsible for maintaining the confidentiality of your account credentials and for providing accurate account information.

Please contact us promptly if you believe your account has been accessed without authorization.

12. Intellectual Property

Unless otherwise stated, the content created by Yoshimin for this website, including text, graphics, logos, photographs, layout, and other original materials, may not be reproduced or commercially used without permission.

Product names, character names, trademarks, artwork, and other intellectual property belonging to manufacturers, licensors, publishers, or other rights holders remain the property of their respective owners.

13. Third-Party Services

Our store uses Shopify and may use third-party payment providers, shipping carriers, analytics services, marketing services, and other service providers.

Your use of certain third-party services may also be governed by the terms and privacy policies of those providers.

We are not responsible for third-party websites or services that are outside our reasonable control, except to the extent that applicable law makes us responsible.

14. Errors and Corrections

Occasionally, information on our website may contain typographical errors, pricing errors, inaccuracies, or omissions.

We may correct such errors and update information where reasonably necessary.

If an error materially affects an order you have already placed, we will contact you where appropriate and provide any remedy required by applicable law.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Yoshimin is not liable for losses caused by circumstances outside our reasonable control.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, nor does anything in these Terms restrict mandatory consumer protection rights.

16. Privacy

Our collection, use, disclosure, and protection of personal information are governed by our Privacy Policy and applicable privacy laws.

Our use of cookies and similar technologies is also subject to our Customer Privacy settings and Cookie preferences.

17. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, business practices, or legal requirements.

The current version will be published on this page. Updates apply prospectively as permitted by law and do not retroactively remove rights that have already arisen under an existing purchase or applicable law.

18. Governing Law

These Terms are governed by the laws of Japan.

However, where mandatory consumer protection laws of your country or region apply to your purchase, nothing in these Terms deprives you of the protections provided by those laws.
